I know , i know, your rushing to that post reply button to make a nearly unbeatable argument that leads to a derail of this thread, might as well refrain from doing that for the safety of this thread.
On topic at hand: Ive tried other methods of attempting 3ds2dx to work but to no avail, i could really use some assistance as soon as possible.

ANYWAY, Red, well since you're having troubles with 3ds Max, why not do this;
Open up your model in 3ds Max, export as a ".3ds", now open up Milkshape, and import as "Autodesk 3ds"
From Milkshape now, export as "Deus Ex .3d"

I can't find the Deus Ex option in export, i think there was a plugin for that.

Well i can't get the hat to higher or fix the rotation from milkshape/3ds max, however i think the rotation can be fixed on the script ( the scipt is a few post back in case you want to take a look)

Can you give us all the sauce? Like, the whole folder maybe? Along with the MS3d/.max of the hat(s)?

So you basically cant put the hat on the model's head? If I understood it properly, then that is your problem
Can't you place the hat on the eye? So then you just have to move the BaseEyeHeight a bit upwards and you're done

UPDATE: Thanks to poor, i managed to "fix" the problem with the height of the hat, however this created new issues.
1: Crouching or feign death with a hat on destroys it.
2: The hat obstructs the player's view
3: Leaning freezes the hat in its original place before leaning, however switching to the hat summoner puts it back on the player's head
4: (Not really an issue, more like an accidental "extra") You can set the rotation of the hat while holding the hat summoner.
Sshot below.
